France was among the first states that announced they would uphold the court’s decision, although officials have not explicitly said they would arrest Netanyahu.

However, the ministry on Wednesday alleged that Netanyahu is covered by immunity as a sitting head of government because Israel is not a member of the ICC. It is the first time a member of the court has argued this in Netanyahu’s case.

France’s argument was previously used by states that refused to arrest Russia’s Vladimir Putin and Omar al-Bashir of Sudan. But the court has consistently rejected those arguments as unfounded.

      the worst part is, it seems to be working. gen z had more access to truth than any generation before, but instead they only got propaganda. they got prageru kids, they got a youtube altgorithm that “randomly” pushed nazi shit, they got social media platforms that disencentivize engaging on issues

      Because most people in high ranking positions can see themselves in Putin’s shoes before they can see themselves in our shoes. They worry if they do it to Putin someones coming for them next. Kind of the same way the Democrats systematicaly let Trump get away with everything his first term.

      Because it’s the western world’s biggest aircraft carrier right in the middle of the Middle East. Everything in geopolitics is a strategic decision by everyone trying to get their slice and step on another.

      We used to do that by invading and capturing territory from others, but that has fallen out of favor, so we use “diplomacy” and “soft power” to mostly get what we want. Russia and Israel didn’t get the memo.

        They did get the memo. But just like Trump and his ability to walk all over everything and everyone without repercussions, they are basically saying, “Go ahead. Arrest the leader of a ‘free’ nation and see how quickly the illusion of stability crumbles.” They’re basically pressing the barrel of the other nation’s guns more firmly into their forehead like the “crazy” villain in every shitty action movie daring the hero to turn dark, knowing that if they pull the trigger, there will be a cascading sequence of destabilization and a shattering of the fragile state of “peace” the world has been going through since the end of WW2. Everyone knows we’re precariously perched on the edge of calamity and no one wants to be the one to push over the first domino. Everyone in power is profiting quite nicely and pretty much getting everything they want. There is no need for them to upturn this state in order to bring another political criminal to “justice.” This order won’t last much longer, but that’s because there are external forces like the impending climate collapse will force their hand, not because anyone will stand up and do the right thing. But because there are no other options left but to gamble on the future of this existing order.

        If your aircraft carrier is not only commanded by a deranged criminal, but also manned by a crew of lowlife criminals (IDF) attacking any and everyone as well as taunting and mocking you, while you pay their everything, it is time to retire it.

    So yeah, there is no credibility for the ICC. Because of the actions of these countries, the ICC is now a theater court for theater cases. The whole world was watching and it was demonstrated that its use is merely a political tool for countries that aren’t part of a specific sphere of influence and not an impartial court of international law.

    What a shame and disgrace. We will ALL suffer the repercussions of the actions taking place today by countries such as France, the US and Germany.

        It’s still the most powerful court in the world, even if countries who agreed to respect it cower away from their promises when it comes time to act.

        Netanyahu is a war criminal who is extending a conflict to avoid going to prison for his corruption conviction.

    According to Article 27 of the Rome Statute, all wanted persons are equal before the court, including heads of a state or government. No immunities under international law may bar the court from exercising its jurisdiction.

    “No international court has ever found that a head of state or high ranking individual has immunity before it, and Article 27 was meant to codify that principle,” [says] “Leila Sadat, a leading expert on immunities and former ICC special advisor on crimes against humanity[.]”

    The immunity loophole found in Article 98 (1), according to the judgement, must be read in context and interpreted in a manner that is consistent with the object and purpose of the Rome Statute, meaning that it should not be read to carve out an exception to Article 27’s clear provisions.

    … the reference to state immunity under Article 98 (1) is related to the immunity of a state and its property, not its leaders or officials.

    When you look at ICC arrests and only see black and brown people you have to agree with France. Is Netanyahu a leader of an African country? Is he Muslim? Then the ICC isn’t going to get an arrest.

    I’m surprised they’re even bothering to make a deal out of this considering putting any sort of stance against Israel would be in direct opposition to the USA, which literally every other country has refused to do out of fear or collusion.

    Not to mention the ICC really only functions when someone either loses or is kicked out of their own country. People made a big deal of no one arresting Putin as if anyone was actually going to take on Russia by themselves by arresting Putin.
